Article 5: Prohibited AI practices

Article 5 prohibits placing on the market, putting into service or using AI systems that deploy subliminal, purposefully manipulative or deceptive techniques, exploit vulnerabilities, perform social scoring, and the other practices listed in Article 5(1). The prohibition binds every operator regardless of role or risk classification elsewhere in the Regulation.

How to satisfy it: Enforceable since 2 February 2025 and carrying the highest penalty tier. This is a gate rather than a checklist item: if a practice falls under Article 5 no amount of downstream compliance work makes it lawful. Screen for it before any risk classification.
