Article 86: Right to explanation of individual decision-making

deployer · high risk · Article 86

Any affected person subject to a decision taken by the deployer on the basis of the output of a high-risk AI system listed in Annex III, other than those under point 2, which produces legal effects or similarly significantly affects them in a way they consider adversely impacts their health, safety or fundamental rights, has the right to obtain clear and meaningful explanations from the deployer of the role of the AI system in the decision- making procedure and the main elements of the decision taken.

How to satisfy it: The deployer-facing counterpart to the Article 85 complaint right. It is an on-demand obligation: the duty is to be operationally able to answer, which means knowing which decisions were AI-assisted before anyone asks.
